Beard sparks legal debate in Fort Hood shooting case | The Raw Story

FORT BELVOIR, Virginia ? Lawyers argued in a US military court Thursday over whether the soldier accused of the Fort Hood massacre can keep his beard despite objections from the judge overseeing his court-martial.

A government attorney insisted Major Nidal Hasan, charged with the November 2009 shooting spree, had to conform to US Army regulations prohibiting beards and that the judge in the case was well within his rights to issue an order for the suspect to be forcibly shaved.

?This is akin to wearing a sign that says ?F-you judge,?? Captain Kenneth Borgnino told the Army Court of Criminal Appeals.

Hasan?s bushy ?unkempt? beard is a ?flagrant violation? of military grooming standards and the judge had clear authority to maintain decorum in his courtroom, he said.

?It is an offense to uniform, to the army? to the panel (jury), to members of the gallery and to the victims,? Borgnino added.

The beard could also be interpreted as a defiant act by Hasan to associate himself with Islamic extremists, the lawyer said.

With legal disputes over Hasan?s beard holding up the trial, a seven-judge panel listened to more than an hour of arguments over whether the accused had to show up in court clean-shaven.

A decision is expected within days.

Hasan?s lawyers said the judge presiding over the court-martial, Colonel Gregory Gross, had no legal right to order their client to be forcibly shaved and that the judge?s stance had undermined his impartiality.

?We believe the military judge exceeded his authority,? Lieutenant Colonel Kris Poppe said.

?Forcible shaving exceeds the authority of the military judge.?

Hasan has said he grew the beard out of devotion to his Islamic faith and his lawyers say orders demanding that he be shaven violate his civil liberties under the Religious Freedom Restoration Act adopted in 1993.

The defense attorneys also asserted that Hasan?s beard had not in any way interfered with the court-martial proceedings.

?He has sat through several proceedings throughout this trial and not disrupted the proceedings,? said Captain Kristin McGrory.

Hasan, who was shot by police officers during the rampage and left paralysed from the neck down, was not in the courtroom Thursday. He has attended hearings in Texas, where his court-martial is due to take place.

Hasan is accused of opening fire at the sprawling Fort Hood army base on November 5, 2009, in an attack that killed 12 soldiers and a civilian, and wounded 32 others. If convicted, he faces a possible death sentence.

NEW YORK (AP) ? Derek Jeter hit an RBI triple just past bubble-blowing center fielder Adam Jones, moving the New York Yankees into a 1-all tie with the Baltimore Orioles after three innings Wednesday night in Game 3 of their AL division series.

The best-of-five series was tied at 1 game apiece, with all remaining games in the Bronx.

With Russell Martin on third following a one-out double off Miguel Gonzalez, Jeter hit a ball deep to right-center. Jones, a blowing a big, pink bubble as he tried to track it down, didn't anticipate it tailing to right as much as it did. The ball dropped just beyond the All-Star's outstretched glove as he crashed into the wall.

Ryan Flaherty homered over the right-field short porch in the top of the third, putting the Orioles ahead.

Taken by the Orioles from the Chicago Cubs in December's winter meetings draft of unprotected players, Flaherty connected on an 82 mph slider from Hiroki Kuroda for Baltimore's first postseason home run since 1997. It was just the second at-bat of the series for Flaherty, who platoons with Robert Andino at second base.

Kuroda, making his first postseason start in three years, gave up three hits in the first three innings, walked none and struck out one. Gonzalez, in his first playoffs start, allowed three hits, struck out two and walked none.

In Game 4 on Thursday night, Phil Hughes (16-13) starts for the Yankees. The Orioles had not decided between lefty Joe Saunders (9-13) or righty Chris Tillman (9-3).

Gonzalez, a 28-year-old rookie, was released by Boston in December, started the season in the minor leagues and made his first major league start on July 6. He went 9-4 with a 3.25 ERA.

Kuroda, a 37-year-old veteran of 11 seasons in Japan, is completing his fifth year in the big leagues and first with the Yankees. He was 16-11 with a 3.32 ERA and won his final two regular-season starts after struggling for much of the second half.

Nate McLouth led off the game with a single to right but J.J. Hardy flied out and McLouth was caught stealing at second by Martin. McLouth reached the base in time but Jeter slapped him on the back of his left leg, pushing McLouth off the base. Orioles manager Buck Showalter argued unsuccessfully with second base umpire Mike Everitt.

Nick Swisher, who had been 0 for 6 with five strikeouts against Gonzalez, singled up the middle with one out in the second to become New York's first baserunner. Mark Teixeira, who had been 4 for 8 in the opening two games, bounced into a 3-6-3 double play.

Martin hit a one-hop double off the left-field wall leading off the bottom of third. Martin advanced when Eric Chavez grounded sharply to first as Mark Reynolds made a diving stop. After Jeter's first triple since August 2011, Ichiro Suzuki flied out to center.

How cancer cells break free from tumors: Study identifies adhesion molecules key to cancer?s spread through the body

ScienceDaily (Oct. 9, 2012) ? Although tumor metastasis causes about 90 percent of cancer deaths, the exact mechanism that allows cancer cells to spread from one part of the body to another is not well understood. One key question is how tumor cells detach from the structural elements that normally hold tissues in place, then reattach themselves in a new site.

A new study from MIT cancer researchers reveals some of the cellular adhesion molecules that are critical to this process. The findings, published Oct. 9 in Nature Communications, offer potential new cancer drug targets, says Sangeeta Bhatia, the John and Dorothy Wilson Professor of Health Sciences and Technology and Electrical Engineering and Computer Science, and leader of the research team.

"As cancer cells become more metastatic, there can be a loss of adhesion to normal tissue structures. Then, as they become more aggressive, they gain the ability to stick to, and grow on, molecules that are not normally found in healthy tissues but are found in sites of tumor metastases," says Bhatia, who is also a member of the David H. Koch Institute for Integrative Cancer Research at MIT. "If we can prevent them from growing at these new sites, we may be able to interfere with metastatic disease."

Lead author of the paper is Nathan Reticker-Flynn, a PhD student in Bhatia's lab. Other authors are former students David Braga Malta and Mary Xu, postdocs Monte Winslow and John Lamar, and research scientist Gregory Underhill. In addition, Richard Hynes, the D.K. Ludwig Professor of Biology and a member of the Koch Institute, and Tyler Jacks, director of the Koch Institute, are contributing authors on this study.

Losing and gaining adhesion

Cells inside the human body are usually tethered to a structural support system known as the extracellular matrix, which also helps regulate cellular behavior. Proteins called integrins, located on cell surfaces, form the anchors that hold the cells in place. When cancer cells metastasize, these anchors let go.

In this study, the researchers compared the adhesion properties of four types of cancer cells, taken from mice genetically engineered to develop lung cancer: primary lung tumors that later metastasized, primary lung tumors that did not metastasize, metastatic tumors that migrated from the lungs to nearby lymph nodes, and metastatic tumors that travelled to more distant locations such as the liver.

Building on a system they first described in 2005, the scientists developed technology allowing them to expose each type of cell to about 800 different pairs of molecules found in the extracellular matrix. After depositing cells onto a microscope slide in tiny spots -- each containing two different extracellular matrix proteins -- the researchers could measure how well cells from each tumor type bound to the protein pairs.

The new technology is a huge step forward from current experimental methods for studying cellular adhesion, which are limited to much smaller numbers of cells and adhesion molecules, says Jan Pilch, an assistant professor at the University of Pittsburgh School of Medicine.

"They've not only scaled this up dramatically, they're able to study the adhesion proteins in combination, which allows them to identify adhesion synergies," says Pilch, who was not part of the research team.

The researchers were surprised to find that adhesion tendencies of metastatic cells from different primary tumors were much more similar to each other than to those of the primary tumor from which they originally came. One pair of extracellular matrix molecules that metastatic tumors stuck to especially well was fibronectin and galectin-3, both made of proteins that contain or bind to sugars.

Although metastatic tumor cells share adhesion traits, they may take different pathways to get there, Reticker-Flynn says. Some tumor cells alter the combination of integrins that they express, while others vary the types of sugars found on their surfaces. All of these changes can result in higher or lower affinities for certain molecules found in the extracellular matrix of different tissues.

In an analysis of human tumor samples, both primary and metastatic, the researchers saw similar patterns. Specifically, they found that the more aggressive the metastasis, the more galectin-3 was present.

Previous studies have suggested that tumors pave the way for metastasis by secreting molecules that promote the development of environments hospitable to new cancer growth. Accumulation of galectin-3 and other molecules that help tumor cells colonize new sites may be part of this process, the researchers say.

"There's a lot of evidence to suggest that a hospitable niche for the tumor cells is being established prior to the cells even arriving and establishing a home there," Reticker-Flynn says.

Preventing cancer spread

The findings offer potential new ways to block metastasis by focusing on a specific protein-protein or protein-sugar interaction, rather than a particular gene mutation, Reticker-Flynn says. "If those changes do confer a lot of metastatic potential, we can start thinking about how you target that interaction specifically," he says.

The researchers tested this approach by genetically knocking down the amount of an integrin found on the surface of cancer cells, which they had identified as interacting with fibronectin and galectin-3. In those mice, tumor spread was reduced. Other possible therapeutic approaches include blocking binding sites on fibronectin and galectin-3 with antibodies, so tumor cells can't latch onto them.

To help with efforts to develop such drugs, the research team is now trying to figure out the details of tumor cells' interactions with galectin-3 and is developing new candidate therapeutics aimed at inhibiting those interactions.

The research was funded by Stand Up to Cancer, the Koch Institute Circulating Tumor Cell Project, the Harvard Stem Cell Institute, the National Cancer Institute, the Howard Hughes Medical Institute and the Ludwig Center at MIT.

(AP) ? Eager to expand in the United States, China's biggest technology companies face an America anxious about threats to jobs and national security.

The latest blow: A U.S. report that says telecom equipment makers Huawei Technologies Inc. and ZTE Corp. are potential security threats that Americans should avoid doing business with.

The report, coming amid an American presidential race in which trade tensions with Beijing are a prominent issue, highlights conflicting U.S. sentiments toward China, an important trading partner but a potential strategic rival. U.S. companies see China as both a crucial growth market and a source of competition and industrial spying.

"A lot of people in America are worried about a diminishing role in the world and China being the prime beneficiary and potentially one day moving into that top slot," said Charles Maynard, senior managing director of Business Development Asia, which advises companies on acquisitions.

Legislators are "playing to a lot of voters at home who are very concerned about that issue," he said.

The report Monday by the House Intelligence Committee said U.S. companies should avoid doing business with Huawei and ZTE and recommended regulators block them from buying U.S. companies. It said government computer systems should not include components from them because they might pose an espionage risk.

The report has no official force but could discourage American telephone carriers from dealing with Huawei and ZTE, especially when it comes to the big-ticket network technology the Chinese companies are eager to sell.

Huawei and ZTE, both based in Shenzhen in southern China, near Hong Kong, rejected the accusation and complained the committee failed to provide evidence to back it up.

The report "employs many rumors and speculations to prove non-existent accusations," said a Huawei spokesman, Scott Sykes, in an e-mail.

"We have to suspect that the only purpose of such a report is to impede competition and obstruct Chinese ICT companies from entering the US market," Sykes said.

ZTE said the investigation should be extended to Western suppliers because their equipment is manufactured in or uses components from China.

The United States and other governments welcome the small but growing flow of Chinese investment. Most deals abroad go through with little trouble. But companies from China's government-dominated economy carry unusual political baggage that has stymied transactions in sensitive areas such as energy and telecommunications.

Last year, Huawei was forced to rescind its purchase of a small California computer company, 3Leaf Systems, after a U.S. government security panel rejected the deal.

Huawei, founded in 1987 by a former Chinese military engineer, has grown into the world's biggest supplier of network gear, competing with Nokia Siemens Networks and Sweden's Ericsson AB.

"They are the first Chinese company to present a viable, sustainable competitive threat to what has long been perceived as America's core competitive advantage, which is innovation and high technology," said David Wolf, a technology marketing consultant in Beijing. "No matter what firm stepped into that, it would be caught in the barbed wire."

Huawei, with 140,000 employees, says it made two-thirds of its 204 billion yuan ($32 billion) in sales last year outside China. The smaller state-owned ZTE says it made just over half its revenues abroad. Huawei says it is employee-owned and has denied suggestions it is controlled by the ruling Communist Party or is a front for the military.

Both companies are well-established suppliers to other developing countries and want to expand in lucrative U.S. and European markets. Huawei sells smartphones in the United States under its own brand.

Other governments also have questioned Huawei's suitability. Australia's government disclosed in March that Huawei was banned from bidding to help build a nationwide high-speed Internet network due to concern about cyber-attacks traced to China.

Huawei has been hurt by its reluctance to release details of who controls the company. Such secretiveness is common among major Chinese companies but unusual in Western markets. In contrast to American CEOs who are expected to act as their companies' public face, Huawei founder Ren Zhengfei never talks to reporters and rarely appears in public.

Huawei has tried to ease U.S. concerns by hiring American executives and spokespeople. It has taken reporters on tours of its sprawling, leafy campus in Shenzhen. In the congressional investigation, it handed over information about members of its board of directors and names of employee shareholders.

In Britain, Huawei has set up a testing center where government technicians can examine its equipment.

"They are going to have to move more quickly," said Wolf. "They need to put their most senior executives in front of the American public."

In other industries, Chinese executives are reluctant to pursue deals in the United States if they think they might be subjected to the unfamiliar and uncomfortable scrutiny of a government security review, Maynard said. He said those might apply even to such acquisitions as an auto parts producer that makes a small portion of its sales to the U.S. military.

Last month, President Barack Obama blocked Chinese-owned Ralls Corp. from owning four wind farm projects in Oregon near a Navy base where the U.S. military flies unmanned drones. Obama acted after the same government review panel that rejected Huawei's acquisition of 3Leaf said there was no way to address possible security risks.

"This has the potential to cut both ways," said Maynard. "If you want American companies to be welcome in China, you need to be making them welcome in the U.S."

It?s an unfortunate symptom of the times when pet owners are forced to make heartbreaking decisions regarding their pet?s health care because of financial difficulties. The cost of veterinary care can often be quite high in the case of serious injury or illness and many pet caregivers simply cannot afford the care their pets need. This can result in painful decisions to surrender or even euthanize their pets. The Dueces Project is a newly-formed organization with a mission to be a safety net for animals in need. DogTipper recently spoke with Michael Moore of the Dueces Project.

Can you please describe The Dueces Project:

The Dueces Project is a start-up organization dedicated to helping pets when their owners cannot provide adequate health care for them due to financial constraints. Many pet owners who are struggling with financial issues must make painful decisions regarding health care for their pet. At the Dueces Project, we believe that these pet caretakers shouldn?t have to say goodbye to their beloved pets either by surrendering them for adoption or, in some cases, deciding to euthanize. The Project works with a network of US veterinary clinics, offering financial aid including complete treatment to pets and their owners.

To do this, we rely on the support of our donors to help us fulfill the promise of our society in caring for animals that otherwise would go without treatment, or worse.

Having secured links with regional clinics across the US, we are alerted when an animal faces euthanization or surrender because of financial limits. Through our Project Life Saver initiative, we work with the clinic to verify the owner?s financial need and then provide funds to save the pet. The owner is never asked to reimburse us for the assistance.

What made you decide to create this organization?

In a word: Dueces. This wonderfully brave, caring dog inspired The Dueces Project (TDP) with its mission to serve as the life saver of animals. You can read his moving story on the Dueces Project.org website.

What is the criteria for assistance, both in terms of the owner?s financial situation and the pet?s physical condition?

Working together with the veterinary clinic or hospital, we verify that the pet owner is unable to provide the funds needed to save their sick or injured pet. This means that they have already applied for CareCredit.com. We then work out the financial arrangements with the clinic and authorize the treatment needed to save the pet. This assistance is normally only offered to those that cannot start a fundraiser for their pet or for animals who need emergency funding.

What region(s) do you serve?

We establish regional links with veterinary clinics across the United States. We work within our application process, asking pet owners to fill out the information about the closest veterinary clinic that is near the pet or animal at the time!

We are currently working on an online platform that will be launched very soon! This platform will allow pet owners that don?t need emergency funding right away or who have time before the pet?s surgery to fill out this ?online fundraiser? and submit it and let others help them raise the funding. This platform will be similar to other ones that you can find online to raise funding, but Funds4Pets.com?s purpose and belief is very simple:

Purpose:
To help Animal Shelters, Animal Rescues, Vet Clinics, Vet Hospitals and private pet owners find a way to raise funds quickly to support those animals in their care and to allow supporters to fund these animals that are in need.

Belief:
We believe that animal shelters, rescues, clinics, and hospitals are doing the most important work in the world to save these pets of ours and need as much support as possible.

We will be happy when this platform is launched due to the fact that the percentage taken from each person?s ?fundraiser? will go directly to The Dueces Project. This means if you launch a fundraiser on Funds4Pets.com then they will take a percentage of the funds raised and give them to The Dueces Project. This will help people that don?t have the time to launch a fundraiser for their animal or pet, because the funding will already be in place with The Dueces Project!

GM says Sept China auto sales up 1.7 percent on year

BEIJING (Reuters) - General Motors Co's auto sales in China climbed only 1.7 percent in September, barely benefiting from its Japanese rivals' plunging sales, in contrast to European and South Korean carmakers.

Deliveries of GM's 'Wuling' micro vans, a brand which accounts for nearly half of GM's China sales, came to 119,510, up a marginal 0.4 percent from a year earlier as a weak Chinese economy hurt small business owners, the Wuling's key buyers.

Sales at GM's car venture with SAIC Motor Corp edged up 3.7 percent, compared with a 17.4 increase in September 2011.

GM appears to have missed an opportunity to step into the gap left by Toyota Motor Corp , Honda Motor Co and Nissan Motor Co , whose sales have fallen as a result of an outbtreak of anti-Japanese sentiment in China, analysts said.

"German and Korean players are the biggest beneficiaries from the woes of the Japanese as they are much more competitive in the SUV segment," said John Zeng, Asia Pacific director for industry consultancy LMC Automotive.

Sales of Japanese cars in China have dropped since protests erupted across the country in mid-September over the Japanese government's purchase of a group of disputed islands in the East China Sea.

Toyota's China sales fell 40 percent in September from a year earlier, and sales at Mazda Motor Corp were down 35 percent.

BMW , however, boosted its China sales by 55 percent in the month, Audi by 20 percent and Mercedes-Benz by 10 percent.

For the first nine months of 2012, GM's sales in China were up 10 percent to 2.08 million vehicles.

Rape DNA process 'not adequate'

Forensic procedures carried out by a private firm which wrongly linked the DNA of a man to a rape were "not adequate", a report says.

Adam Scott, from Devon, was held for a couple of months after being accused of raping a woman in Manchester.

The charges were dropped when it emerged a DNA sample had been contaminated at LGC Forensics.

Forensic Science Regulator Andrew Rennison said Mr Scott was an "innocent victim of avoidable contamination".

LGC Forensics said that it "deeply regrets the incident of contamination".

Mr Scott was charged in 23 October 2011 after a plastic tray containing a sample of his DNA was re-used in the analysis of a swab from a rape victim in Plant Hill Park, Blackley. The result of that test linked him to the crime.

The report said police investigating the rape allegations raised concerns seven weeks later because phone records suggested Mr Scott had been in Plymouth a few hours after the alleged attack.

In March this year, the government wound up the Forensic Science Service, leaving private companies and police laboratories to take on its work.

That month, news emerged of the DNA mix-up involving Adam Scott at the Teddington lab of the biggest private provider, LGC.

Critics of the FSS closure claimed it was no coincidence. LGC had bitten off more than it could chew, they said - pointing to a Science and Technology Committee report the previous year warning that the private sector lacked the capacity to absorb the FSS's market share.

Andrew Rennison's report, however, suggests it was more to do with human error and lax procedures, following the introduction of new robotic equipment.

No other cases of contamination have been identified. It is also worth recalling that DNA blunders are not unique to the private sector - the FSS had its fair share too.

The rape charges were eventually dropped in March 2012.

A few days later Mr Scott said in a statement that he was "angry that I was falsely accused [and] am angry about the amount of pain it has put me and my family through".

Mr Rennison's report said that the contamination was the result of human error by a technician who "failed to follow basic procedures for the disposal of plastic trays used as part of a validated DNA extraction process".

He also said that the procedures themselves were not adequate, which also meant that records were not being maintained by the technicians and nothing was being done to mark trays once they had been used.

He went on to say that some 26,000 other samples have been checked and no further errors had been identified.

The re-use of plastic trays was identified on 11 October 2011 and should have triggered a more comprehensive response than that undertaken, the report added.

'Corrective actions'

"These errors were compounded by the failure at LGC to consider the possibility of contamination despite concerns expressed by the investigating officer about the reliability of the DNA profile," Mr Rennison said.

Radio 4's The Report investigates the state of the forensic science industry in the UK and speaks to a man wrongly accused of murder because of flawed DNA testing.

A Home Office spokesman said: "Andrew Rennison's independent report has found the incident was caused by human error and failures at LGC Forensics to respond to warning signals.

"Both he and the UK Accreditation Service are content that processes have been put in place to stop this happening again."

But Mr Scott's mother, Michelle, told BBC Radio Devon that "all procedures" at forensic firms such as LGC needed to be improved.

"They need to make sure that everything they're doing is checked and double-checked to make sure that everybody has a fair chance."

She added: "I would not wish this on anybody or anybody's family - what we've had to go through for five whole months."

A spokesman for LGC Forensics said: "The Forensic Regulator and the United Kingdom Accreditation Service have expressed their satisfaction with our investigation into the incident, the corrective actions and LGC's overall contamination avoidance and checking processes.

"LGC treats incidents like this with utmost seriousness and we look forward to continuing to provide excellent forensic services to the Criminal Justice System."

The government's decision to close the Forensic Science Service (FSS) in England and Wales in March was criticised by the cross-party House of Commons science and technology committee, which said the government had not given sufficient consideration to the wider impacts of its closure.

And the forensic science archive, while still in use, stopped accepting new material as a result of cost cutting from March.

The changes to the archive, which holds more than 1.7m case files, mean forces now have to create individual storage systems for forensic material.
