Analysis: Could one music downloader change U.S. copyright law? (Reuters)

NEW YORK (Reuters) ? In the age of iTunes and an-app-for-everything, Joel Tenenbaum's battle with the music industry over illegal downloading seems as relevant as an eight-track cassette.

But it turns out the fight could produce something surprisingly enduring: a change in copyright law.

Back in 2007, Tenenbaum was one of 35,000 individuals sued by Recording Industry Association of America in a legal assault meant to discourage music lovers from illegally downloading songs. While the vast majority of rogue downloaders settled their cases, only Tenenbaum and one other defendant hung on for a trial.

Over the course of the litigation, Tenenbaum's testimony earned him some notoriety -- he blamed the downloading on burglars, a foster child and his sisters before finally confessing -- but the digital-rights community continued to support his case. A friend-of-the-court brief supporting Tenenbaum's constitutional arguments was co-authored by members of the Electronic Frontier Foundation, a lobbying group, as well as Stanford and Berkeley law school's clinics on technology and public policy. Harvard law professor Charles Nesson, founder of the school's Berkman Center for Internet & Society, took Tenenbaum on as a client and has been representing him pro bono since 2008.

Now, as Tenenbaum's case enters its next stage, those advocates see a renewed opportunity to push for an answer on how copyright laws should be enforced.

"The system is outdated," said Jason Schultz, an assistant clinical professor of law at Berkeley and the co-director of the Samuelson Law, Technology & Public Policy Clinic. While Tenenbaum is an imperfect - and unsympathetic defendant - he is a vehicle for bringing copyright law up to speed. "It's a real case and a real guy that's been run up for money," said Schultz. A court will eventually make a decision on the issue of appropriate copyright damage, he said. "We're trying to help them make the right one."

$22,500 PER SONG

The stage was set two weeks ago when the First Circuit Court of Appeals reinstated a $675,000 judgment against Tenenbaum, or $22,500 for each of 30 charges of illegal downloading -- a reversal of a trial judge's decision to knock the award down to $67,500. The ruling was a blow to Tenenbaum, who had argued that that the Copyright Act was not meant to be applied to consumer copying and that the recording industry was not harmed. He argued that such a large amount for an individual was unconstitutional and unfair.

"I can't afford the $67,000 it was before. I sure as hell can't afford the bigger amount," Tenenbaum, who now is studying physics as a graduate student at Boston University, told Reuters. He said he will declare bankruptcy if the judgment is upheld.

The Copyright Act, last extensively revamped in 1976, allows plaintiffs to take two approaches to damages. They can either ask for the quantifiable amount of harm caused or seek statutory damages. Today, violators can be forced to pay between $750 and $150,000 per infringement.

The Recording Industry Association of America, and its members such as Warner Bros Records and Sony Music Entertainment, maintain that the current law is fair, offers jurors flexibility and provides the proper deterrent to would-be violators.

DIGITAL RIGHTS ADVOCATES

In the view of digital rights advocates, however, the law is wildly out of line with contemporary technology, where nearly every device allows users to make and upload copies of nearly anything.

In the Tenenbaum case, Schultz and others pushing for changes to electronic rights, were hoping the First Circuit would rule on whether or not the $22,500 per violation statutory damage award was unconstitutional. Courts should "ensure damages bear a reasonable relationship to actual harm" and provide guidance on how statutory damages will be imposed so creators can "adequately navigate the waters of copyright law," the Electronic Frontier Foundation argued in its friend-of-the-court brief.

The First Circuit, however, didn't rule on that issue. It sent the case back down to the trial court, not on the merits of the due process decision, but because it felt the lower court jumped the gun on addressing the constitutional question. The First Circuit did, however, walk through discussion points of reducing statutory damages versus limiting punitive damages.

GREATER DISCRETION FOR JUDGES?

One potential outcome in the Tenenbaum case is that a court will decide to rely on the model of punitive-damages style evaluation, giving judges greater discretion to reduce statutory damage awards in copyright cases. Unlike a common law reward reduction, the plaintiff would not have the immediate right to demand a new trial on damages. That would be a "significant change in the process," said John Chatowski, counsel at Nixon Peabody who specializes in intellectual property litigation.

The issue could also be resolved by the case of the other remaining individual downloader, Jammie Thomas-Rasset. That case is pending before the Eighth Circuit. To date, a jury has twice levied verdicts of over $1 million against Thomas-Rasset; the judge reduced the damages to $54,000 and the RIAA is appealing. Like Tenenbaum's case, Thomas-Rasset's case focuses on the fairness of these types of awards, and could beat Tenenbaum's to a decision.

Tenenbaum's options now are to appeal the First Circuit panel's decision to full First Circuit, to the Supreme Court, or to wait and see what happens when the case is sent back to the lower court. Tenenbaum's lawyer, Charles Nesson declined to comment for this story.

Interflora hails EU legal ruling in keyword battle | Skrill Corporate

Interflora has praised a judgement by the Court of Justice of the European Union, concerning trademark keywords used by internet merchant account sites.

The florist sued Marks & Spencer for using its trademark Interflora name and logo as an internet search engine keyword to advertise M & S flowers. It claimed that this was detrimental to their brand image and could dilute the effects of its trademark branding.

Some instances fall "within the ambit of fair competition" and well-informed and observant internet consumers are unlikely to be confused by alternative sites or products, the European Court of Justice claimed afterwards.

It ruled that M & S would be allowed to continue using the brand's name in online advertisements for its products, so long as it does not cause adverse affects to the Interflora brand or its reputation.

Interflora has argued that this practice impinges on its own search engine optimisation results and could make it more difficult for it to attract online shopping users.

"People searching the internet for 'Interflora' want 'Interflora, the flower experts' and no-one else," claimed Michael Barringer, the florists marketing director.

"Our brand stands for quality and service and together with our network of independent florists, we have spent the last 80 years building this reputation. We are very proud of the Interflora brand and want to protect it for our customers, florists and the future," Mr Barringer explained.

The European Court of Justice has passed the case onwards to the High Court in the UK and said: "It is for the referring court to determine, in the light of the foregoing interpretative guidance, whether, on the particular facts of the dispute in the main proceedings, there is use of the sign without due cause which takes unfair advantage of the distinctive character of the repute of the trade mark Interflora."

Both M & S and Interflora have declared that they are happy with the court ruling and are keen to get the issue resolved.

Michael Barringer commented on the decision on the Interflora company blog, writing "this judgment backs all the hard work and effort we have put in to defending the Interflora brand".

The case was first brought to the UK High Court in 2009, as the florist claimed that it was unfair that M & S were using its trademark as an internet search engine keyword to advertise their own brand flowers.

Since it began, both sides have fought hard to argue that the law is on their side, in a case which has divided internet merchant account opinion.

Earlier last year the European Court of Justice dealt with a related case and ruled in favour of Google, after luxury brand Moet Hennessey Louis Vuitton claimed that the search engine's AdWords service undermines brands, Marketing Week reported recently.

The fashion designer also argued that Google's practice breaches European trademark law by allowing rival advertisers and brands to purchase trademarked keywords.

Makau breaks world record in Berlin Marathon (AP)

BERLIN ? Patrick Makau of Kenya broke the world record to win the Berlin Marathon on Sunday.

Makau pulled away after 27 kilometers (16.8 miles) and finished in 2 hours, 3 minutes, 38 seconds.

Haile Gebrselassie of Ethiopia, who held the previous record of 2:03.59, pulled up after Makau's breakaway and seemed on the verge of giving up when he stopped running and bent over, but resumed the race.

For several kilometers (miles) he was second, about two minutes behind Makau, but appeared to have finally given up before the finish.

Gebrselassie had won four successive Berlin marathons from 2006 and set his world record in 2008.

Makau also won last year's race in driving rain. Sunday's race on Berlin's flat course took place in sunny, mild conditions.

The 26-year-old Makau brandished a Kenyan flag after coming through the landmark Brandenburg Gate and crossing the finish line.

"I was hoping to gain a lot of experience but not to win," he said. "Today maybe a new generation is starting in marathon.

"My body was not good in the morning but I had no problems in the race, I did everything well."

By the 35th kilometer (22nd mile) , Makau was alone in front.

He and Gebrselassie had stayed together until the 27th kilometer (16.8 mile) and were easily on world record pace from the start.

Gebrselassie, 38, pulled out of the New York City Marathon in November with a knee injury and retired immediately after the race. But he changed his mind eight days later.

He injured both knees when he fell during a training run in the rugged countryside of his homeland but came back to win a half-marathon in April in Vienna, Austria. He also won the 10,000-meter (10,940-yard) Great Manchester Run in May.

Stephen Kwelio Chemplany, a pacemaker from Kenya, finished second in 2:07.55, and another Kenyan, Edwin Kimaiyo, was third in 2:09.50.

Florence Kiplagat of Kenya won the women's race in 2:19.44, ahead of Irina Mikitenko of Germany and world record holder Paula Radcliffe of Britain, who was making her Berlin debut.

Mikitenko clocked 2:22.18 and Radcliffe finished in 2.23.46.

Survey reveals strength of loyalty among iPhone owners (Digital Trends)

If there?s one thing a company wants more than anything else, it?s loyalty from its customers. When a refresh of a device comes out, they want owners to dump their current model ? even if there?s nothing wrong with it ? and buy the latest one.

According to the results of a survey carried out by UBS Research, Apple has a retention rate so high ? 89 percent to be exact ? that one has to wonder where it?s going wrong with the small number that do jump ship.

UBS asked 515 smartphone owners which phone they have now and which they?re likely to buy next. The results from the admittedly small sample size show that while Apple?s retention rate is very high, customers of other companies appear to be not very loyal at all.

UBS said of its findings: ?Interestingly, when we look at all consumers who are considering changing handset OEM provider, Apple remains a significant net beneficiary. Alongside Apple, only Samsung and HTC also appear as net beneficiaries (more users won than users lost).?

It continued: ???Interestingly, of our respondents who are current Apple subscribers, only 6 percent indicated that they intended to move to a different OEM, with 4 percent saying they were undecided. This suggests that the retention rate for Apple could end up being as high as 93 percent.??

The data makes somewhat grim reading for Research In Motion, makers of BlackBerry phones and the struggling PlayBook tablet. Its retention rate has dropped dramatically in the last 18 months, from 62 percent to 33 percent. According to UBS?s findings, Nokia is also suffering ? its retention rate has dropped to 24 percent from 42 percent in March 2010.

The sample is so small that it?s hard to read too much into the results, but they most likely gives us a general idea of trends regarding customer loyalty. Trends that Apple will be very happy to hear about.

Cable news avoided economists during debt debate (AP)

NEW YORK ? Economists aren't necessarily the first in line at cable news networks when someone is needed to talk about economic issues.

The watchdog group Media Matters for America said in a report Wednesday that only 4 percent of the people brought on to talk about the debt ceiling issue on CNN, Fox News Channel and MSNBC this summer were actual economists.

Most were politicians. Media Matters said that's understandable, given that Congress and the president decided the issue, but that it was important to include in the debate people with an expertise in the economy.

The findings are similar to a Media Matters report two years ago that said few economists were brought on to talk about stimulus legislation.

Best Buy reviewing British operations: report (Reuters)

NEW YORK (Reuters) ? U.S. electronics retailer Best Buy Co (BBY.N) is talks with shareholders about the future of its stores in Britain, the Sunday Express reported.

Best Buy, which has 11 outlets in Britain through a joint venture with Carphone Warehouse, is undertaking a strategic review of its operations, the report said.

The company did not immediately respond to a request seeking a comment.

When Best Buy first entered Britain in 2010, it intended to expand to open up to 200 stores, but that plan is now on hold, according to the report.

The company last week reported weaker-than-expected quarterly results and cut its profit outlook for the year as shoppers held off on buying televisions and other nonessential items in the anemic U.S. economy.

Best Buy shares closed at $25.43 in Friday.

Moms who eat high-fat diet before, during pregnancy 'program' babies to be fat, at risk

ScienceDaily (Sep. 15, 2011) ? New research in mice indicates that babies born to moms who eat a high-fat diet before and during pregnancy have a higher fat mass and smaller livers than babies whose moms consume low-fat fare, according to scientists at Oregon Health & Science University Doernbecher Children's Hospital.

The good news, the researchers report, is that moms who switch to a low-fat diet during pregnancy considerably reduce the risk of these negative effects. Their findings are published online in the American Journal of Physiology and Endocrinology Metabolism, a publication of the American Physiological Society.

Previous research has shown babies who receive too much or too little nutrition in the womb experience profound and permanent changes in their development -- including alterations in the structure of the liver, brain and pancreas -- that increase their susceptibility to developing various diseases later in life, including obesity, diabetes and cardiovascular disease.

And given that nearly half of women of childbearing age are overweight or obese in the United States, according to the Centers for Disease Control and Prevention, there is a pressing need to inform women and their health care providers of the inherent dangers maternal overeating poses to their child's future health and risk of chronic disease.

"One of the key findings here is that the offspring are born with a marked shift in body composition, away from lean mass and toward fat mass, prior to any dietary exposure in the offspring themselves," said principal investigator Stephanie M. Krasnow, Ph.D., a scientist in the Pap? Family Pediatric Research Institute at OHSU Doernbecher Children's Hospital.

Krasnow and colleagues in the Daniel Marks Lab used a mouse model to examine how consumption of a high-fat diet during pregnancy effects body composition in the newborn. Female mice were fed either a low-fat or high-fat diet for six months and were mated with male mice after 4, 12 and 23 weeks. The females who ate a high-fat diet gained more body weight and had a higher fat mass than the females who ate a low-fat diet. And on the day of birth, babies born to females who had consumed a high-fat food had more body fat, less lean mass, and smaller livers than the newborns of females that consumed low-fat food.

These changes in body composition and organ size occurred before the female mice eating a high-fat diet became obese, the researchers report. And even when the females were not obese, eating a high-fat diet prior to and during pregnancy "programmed" their unborn babies to have increased body fat and smaller livers at birth. Fortunately, the researchers found, switching to a low-fat diet just during pregnancy prevented the infants from accumulating excess fat mass in utero and also prevented their having smaller livers.

"These findings demonstrate that changing to a low-fat diet during pregnancy minimizes the harmful effects of maternal obesity on the newborn's body composition, potentially reducing the child's risk of developing obesity and related diseases later in life," said Krasnow.

The study was funded by the National Institutes of Health and the Burroughs Wellcome Fund.

Boehner vs. Obama: Are US job creators really 'on strike'?

That's how House Speaker John Boehner characterized job creators in a speech Thursday, which came a week after President Obama outlined his own jobs plan to Congress.

Near the top of his speech on the economy, House Speaker John Boehner summed up his view of the problem with this provocative line: ?Job creators in America are essentially on strike."

Skip to next paragraph US House Speaker John Boehner talks about reducing the federal budget deficit and the need to overhaul entitlement programs. Boehner also discusses President Obama's jobs plan and the 12-member congressional "super committee."

He wasn't arguing that employers are engaged in some kind of willful effort to slow down the economy.

Rather, this was Mr. Boehner's way of saying, a week after President Obama gave his own "jobs plan" speech, that the president's policies have been killing business confidence and standing in the way of job creation.

Is the Republican House speaker right?

Well, "strike" may not be quite the right word. When businesses have to fill a position, they are still hiring. And it's not like employers were setting any records for job creation before Mr. Obama took office.

That said, Boehner isn't making up the issue of frayed corporate confidence out of thin air.

"My sense is that businesses just don't trust Washington after the past couple of years," economist Ed Yardeni told the Monitor last week, citing Obama's health-care reforms. "I've got a small business, and I can tell you for sure that my health-care costs haven't gone down, and they haven't stabilized."

Economists caution against thinking that a sudden personality adjustment in the White House ? making Obama more like Boehner ? would provide a rapid and complete fix to the high unemployment rate. The economy faces a range of problems that, at best, will probably be solved over the course of several years, they say. In fact, a cover story in the Monitor's print edition recently detailed a number of factors that may be interfering with job creation.

Yet prominent business groups, when outlining their own idea of job-friendly policies, fault the Obama administration on some of the same fronts that Boehner did. And some changes in White House ways, they say, could improve the job market meaningfully.

The US Chamber of Commerce, which counts some 3 million businesses under its wing, praised some of Obama's ideas, such as urging Congress to approve free-trade agreements and transportation investments. But it gave no blanket endorsement.

?A workable jobs plan must genuinely reduce regulatory uncertainty, unshackle promising American industries, and not be overly reliant on government spending and subsidies," chamber president Thomas Donohue said in a statement released shortly after Obama spoke.

Boehner's speech didn't include the words, "here's my jobs plan." But the Ohio congressman, citing his own experience in business before entering politics, did call for concrete steps to counter what he called Obama's "triple threat" to businesses:

? Reining in regulation. Boehner said that a certain amount of regulation is reasonable and necessary, but that rules in many cases are "excessive." He pledged that the Republican-controlled House will pass measures designed to remove unneeded impediments to job growth. He also vowed to pass a REINS Act, which would require congressional review for any new regulation that has a major impact on the economy.

? Reforming the tax code. Boehner called for changes to make the tax system simpler for firms and individuals and to encourage investment while removing special-interest perks. ?It strikes me as odd that at a time when it?s clear that the tax code needs to be fundamentally reformed, the first instinct out of Washington is to come up with a host of new tax credits that make the tax code more complex," Boehner said.

? Fixing federal deficits. Runaway spending is another factor hobbling business confidence in the future, he said, adding that a joint congressional committee should focus on restraining deficits through spending cuts, not tax hikes. "That has everything to do with jobs," he said.

US employers aren't uniformly in Boehner's corner. Business owners, like the general public, are divided over the Republican notion of seeking to fix federal deficits without any higher tax revenues, for example.

But the US Chamber of Commerce, in its own jobs plan, highlights some Boehner themes, such as providing "regulatory certainty and relief" and taking action to spur domestic energy production.

The group argues that "millions of new jobs" can be added through such steps, without adding to federal deficits.

On Friday, William Dunkelberg of the National Federation of Independent Business took a direct jab at Obama's recent proposal for temporary payroll-tax cuts and other measures that would drive up the federal deficit next year.

"The more the government tries to do with big spending and borrowing programs ... the more fearful of the future many consumers and business owners will become," Mr. Dunkelberg, the business group's chief economist, warned.

He noted that a sharp drop in consumer confidence this summer coincided with Washington's faltering efforts at fiscal reform, during negotiations over raising the debt ceiling.

But even if business leaders are right that Obama's leadership is, to some degree, impairing job creation, that doesn't mean all would be rosy under a different administration.

Consumer spending is burdened by factors such as high household debt, for example. This weighs on the outlook for businesses that might have the means to invest or hire.

"Even if you're very nice to [employers] and lay out a red carpet,... fundamentally they'll only build widgets if somebody wants to buy widgets," Fareed Zakaria, a policy expert and author of "The Post-American World," said in an interview with the Monitor earlier this week. "Consumer demand simply is weak."

And although the right kind of deficit fix might provide a psychological boost to the nation, it's not clear that less borrowing by government would quickly unleash funds that fuel private-sector job creation, many economists say.

A recent analysis by Goldman Sachs, for example, says that fiscal reforms are needed, but that deficit reduction could hurt economic growth if pursued too rapidly.

Still, Obama and Boehner have some potential common ground. The House speaker gave a nod to infrastructure spending, a part of the Obama jobs plan. The president has issued his own call for making America's corporate tax system more competitive with those of other nations.

And Obama, while resisting a full pivot toward Republican views on regulation, is taking some steps to reduce unneeded regulations.

UK and French leaders to visit Libya (Reuters)

TRIPOLI (Reuters) ? The French and British leaders will visit Libya on Thursday to congratulate the new rulers they helped install, but families fleeing besieged bastions of ousted strongman Muammar Gaddafi are a reminder that peace is still far off.

The visit will be a victory lap for Nicolas Sarkozy and David Cameron, who defied doubters at home to lead a NATO bombing campaign that succeeded in ushering in a victory by forces who swept away Gaddafi's 42-year rule last month.

Both leaders are hugely popular on the streets of Libya, where "Merci Sarkozy" and "Thank you Britain" are common graffiti slogans. Both may hope to earn political dividends back home from what now appears to have been a successful bet.

But on the eve of their visit, the leader of Libya's National Transitional Council said heavy battles lie ahead against Gaddafi loyalists who have refused to surrender.

NTC Vice Chairman Abdel Hafiz Ghogo told Reuters the two leaders would visit both Tripoli and Benghazi, where the NTC rulers are still based even though Gaddafi opponents seized the capital more than three weeks ago.

Western countries and neighbors are anxious to welcome Libya into the international community, not least so it can restart lucrative oil production frozen by six months of war.

Turkish Prime Minister Tayyip Erdogan is expected in Libya on Friday. Egypt's foreign minister, Mohammed Kamel Amr, is also due to visit. A U.S. assistant secretary of state visited on Wednesday.

Libya's new leaders say the international community has been slow to release frozen assets; diplomats said on Wednesday Britain had circulated a draft resolution to the United Nations Security Council to ease sanctions against Libya's National Oil Corp (NOC) and central bank and hoped for a vote this week.

NOC chairman Nouri Berouin told Reuters Libya would start exporting crude oil from the eastern port of Tobruk within ten days and could produce 1 million barrels a day within six months.

But the failure to capture Gaddafi, and ongoing fighting in and around besieged towns still firmly held by the ousted leader's supporters, are proof that a peaceful and prosperous future for Libya is far from assured.

The European Union on Wednesday demanded an end to arbitrary killings and detentions by both sides, and especially to vigilante attacks on sub-Saharan Africans and black Libyans, who are widely accused of having fought for Gaddafi.

FIGHT "FAR FROM THE END"

Gaddafi has not been seen in public since June. In a letter read out on Syria-based Arrai TV he called on the U.N. Security Council to protect his hometown of Sirte -- still held by forces loyal to him -- from what he called NATO "atrocities."

"If Sirte is isolated from the rest of the world in order for atrocities to be committed against it, then the world has a duty not to be absent," Gaddafi was quoted as saying.

His spokesman, Moussa Ibrahim, speaking on a satellite phone from an undisclosed location, told Reuters the 69-year-old leader was still in Libya, in good spirits and ready to fight.

"The leader is in good health, in high morale ... of course he is in Libya," said Ibrahim, who declined to give his own location. "The fight is as far away from the end as the world can imagine. We are still very powerful, our army is still powerful, we have thousands upon thousands of volunteers."

The need for Sarkozy and Cameron to visit Benghazi as well as Tripoli is a sign of the obstacles Libya still faces in transforming itself into a peaceful, unified democracy. The NTC has not yet been able to safely establish a government in a capital still bristling with militiamen from disparate groups.

The country is deeply divided. Many of its new rulers hail from Benghazi in the east, while the fighters who won the battle for Tripoli mostly come from towns in the west. The NTC has promised to name a more inclusive government lineup within days.

Ghoga, the NTC deputy chairman, told Reuters in Benghazi that Abdel Jalil and the NTC would remain based there at least until the "liberation" of cities in Gaddafi's supporters' hands.

FIERCE FIGHTING

NTC Chairman Mustafa Abdel Jalil called for equipment to fight what he predicted would be hard battles against Gaddafi loyalists near the city of Sabha deep in the Sahara desert.

"There will be a lot of fierce fighting in this area," he told BBC TV. "We ask for support to get the right equipment in order to conquer these troops and to proceed further south to try and capture colonel Gaddafi and his family."

He said Gaddafi would be planning attacks on oil fields, cities or power plants.

Towns held by Gaddafi loyalists have proven tenacious despite weeks of siege. After a week of fighting, NTC forces at Bani Walid 150 km (95 miles) southeast of Tripoli have been urging people to leave before they try to storm the town.

Scores of cars packed with families left Bani Walid on Wednesday as NTC forces broadcast messages telling them to go and handed out free petrol to help them escape.

"There is a lot of random shooting. It is much safer for my children to leave. Gaddafi militia men do not want to negotiate," Fathalla al-Hammali, 42, said, driving away from the town with his three young children.

Daw Saleheen, who is heading regional forces battling for control of Bani Walid, said he was ready to use heavy weapons against an estimated 1,200 loyalists, who had placed rockets and mortars on civilian homes as well as dozens of snipers.

"We know all their positions," Saleheen told reporters on the northern outskirts of his home town. "We have sent a message to all civilians that if they can they must leave now."
